I think, based on the masculine hand wearing the ring we saw on her shoulder in the ATM photo that Kate was taken by another man, which of course will totally, retroactively make the stalking not only okay but good when Neal finds out. See, he was right not to assume she was the sort of awful woman who thinks she is her own self and can break up with a man and move out without his permission!
Do you think it's possible that there was something going on she was scared of that she actually *did* ask Neal for help with, and when his reaction was "but i've only got x much time left on my sentence" she got pissed and left to handle it on her own, while he started freaking out and trying to get out in time to help her? There seemed to be recognition from Neal about the hand which might support the idea that he already knew. I'm not sure it's possible to fit this in around the "wine bottle is goodbye" though.
It's frustrating that's there's so little to work with, and from the way the show is laid out I have a feeling that we'll never really get confirmation on who knew what when, so nothing that'll neatly clear up the stalking charges.
But if we overlook the misuse of public resources, maybe the stalking is a fully consensual, fun and freaky game they like to play?
I think I shall choose to subscribe to this theory, with the addendum that it is mutual and Emily regularly reads all of his case files and expense reports.
